Dezignz Outdoors in Stanislaus County

BEWARE! Public service announcement here. Please avoid the fraud Luis M. Oliveira, doing business in Stanislaus County as “Dezignz” or “Modern Dezignz.” Luis has a history of defrauding others. In the summer of 2021, Luis contacted Koverton’s sales representative with whom he had done business in the past for other suppliers. Luis said was looking to purchase Koverton furniture for his clients in Turlock, CA for the grand opening of a store. Luis submitted a purchase order to Koverton for the furniture, along with a credit card deposit form with his sister Susete A. Oliveira’s name and credit card information. Koverton’s first attempt to charge the card for 50% of the order was declined. Koverton staff contacted Luis right away regarding the matter. Luis told Koverton that he would call us back once he settled the matter with the credit card company, which he did, and Koverton’s second attempt to charge the card worked. Luis told Koverton that he had used all of his client’s moneys so that was why he had to use his sister’s credit card.By the end of August 2021, Koverton was ready to ship Luis’s order and we charged the remaining 50% balance on the same credit card. The final charge went through and the goods were picked up and delivered to Luis a few days later. About one week after Luis received the shipment, however, Koverton was contacted by its credit card processing company stating the two charges on the credit card used by Luis had been disputed as fraud. Koverton immediately contacted Luis and he told us numerous times that was going to sort it out with his sister. Unfortunately, weeks went by with no resolution by Luis or Susete. Numerous phone calls, e-mails and text messages by Koverton went unanswered. Continued refusal to pay for our product. Koverton disputed this matter with its processing company and provided all documentation to show that Koverton shipped the product as agreed. The processor informed Koverton that the case could not be reversed and that Koverton’s only recourse was to take legal action against the Oliveiras to recover the goods or the funds promised to Koverton as payment. Koverton really didn’t want to have to go to court, but seeing as we had no choice, we did so.On March 30, 2022, the Los Angeles Superior Court entered a judgment in favor of Koverton against Luis and Susete Oliveira for “Breach of Contract, Common Counts, and Fraud (Promise Without Intent to Perform).” So far, not surprisingly, the Oliveiras have refused to pay any money on the judgment. As far as we know, the Oliveiras also have not appealed the judgment.
